Documenting this Battle for Trans Civil Rights: An Impactful Documentary Reveals the Personal Story

Transgender documentarian Sam Feder's latest feature "Heightened Scrutiny" provides a moving two-part viewpoint – simultaneously an emotional profile of a prominent trans activist and a critical analysis of journalistic coverage about trans rights.

Judicial Battle at the Supreme Court

The film traces ACLU lawyer Chase Strangio as he gets ready for legal presentations in the significant Supreme Court case US v Skirmetti. These arguments happened in late 2024, with the court ultimately deciding in support of the state's argument, essentially permitting limitations on medical transition for trans young people to remain in place across multiple US territories.

We created Heightened Scrutiny in only 16 months, shared Feder during a discussion. In comparison, my previous film Disclosure took me five years, so this was a real push. Our goal was to stimulate discussion so people would know more about the case.

Human Narrative Amid Political Struggle

While Feder offers a extensive critique of how mainstream publications have disseminated anti-trans talking points, the film's primary contribution may be its compelling portrayal of Strangio. Typically a measured attorney in public appearances, Strangio reveals his authenticity throughout the production.

This represented a significant challenge, to reveal parts of my life to a filmmaker that I had worked hard to keep confidential, stated Strangio. Feder told me he wanted younger people to know that we tried, to see what was done in service of these battles for our fundamental rights.

Varied Perspectives in the Movement

To support Strangio's narrative, Feder includes multiple trans voices, including prominent figures from media and entertainment. This film also features viewpoints from cisgender supporters who examine how mainstream publications have contributed to harmful portrayals of trans people.

The perspective of trans youth central to the court battle is illustrated through a extraordinary 12-year-old girl named Mila. Audiences initially witness her fighting for her community at a school board meeting, with subsequent scenes showing her speaking for transgender rights outside the Supreme Court.

Personal Scenes Beyond the Courtroom

Heightened Scrutiny also features touching moments where Feder transcends the ongoing political battle, such as sequences of Strangio vacationing in Italy and receiving a tattoo featuring lines from activist Pauli Murray's poem "Vision."

The tattoo sequence is among my favorites in the movie, explained Strangio. Getting inked is nearly like a reflective experience for me, to be totally engaged in my body and to think of it as a container for things that are important to me.

Physical Identity and Portrayal

Feder's attention to lovingly capturing Strangio getting to his tattoo collection emphasizes that Heightened Scrutiny is fundamentally about transgender bodies – not just those of youth who confront denial of their right to live authentically in their own bodies, but also the physical forms of the numerous subjects who participate in the documentary.

I make films with a meaning, and part of that is picking people who are outstanding and articulate enough to hold the camera, stated Feder. When people ask me what they should dress for an filming, my response is anything that makes you feel confident. That is crucial to me – as trans people, we struggle so much with our image.

Impact and Optimism

A key factor that makes Feder's works excel is his clear talent for making his trans participants feel comfortable, seen and valued. This methodology fosters real connection between Feder and Strangio, helping the filmmaker to realize his objective of showing Strangio as a multifaceted individual and providing a testament for posterity of how persistently he and fellow activists have fought for trans liberties.

I hope not people to find themselves in a state of perpetual despair because of what the law is not giving us, explained Strangio. I want to be in a method of using the law to reduce harm, but not to transform it into some kind of channel for our liberation aspirations. The government is not going to be the reflection through which we perceive ourselves. We are that mirror, and it's really vital that we continue having that conversation alongside discussions about resisting these laws and procedures.
